PURCHASING ARTWORK PRINTS

As a Buyer you acknowledge that:

  • Images of artworks on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflect the colour of the artworks. The artworks may vary slightly from those images.
  • It is your responsibility to determine the value, condition and authenticity of the artwork.
  • Your contract to purchase an artwork is with Select Art, unless you are buying an original work of art (see below).
  • It is your responsibility to ensure that you check that the Artwork is in the expected condition at the point of collection / receipt and not to accept it or sign for it if you consider it to be damaged or misrepresented.

PAYMENT FOR ARTWORKS

Accepted Payment Policy

Select Art wants to ensure that our platform offers Buyers safe, appropriate and convenient payment choices. Select Art requires all Sellers listing their Original art works on our site to offer payments through PayPal (with some exceptions set out below).

REGISTRATION, YOUR ACCOUNT AND PASSWORD

Our site is available for users who are at least 18 years old. In order to use our site as a buyer you may be able to register. If registration is available and you choose to register or you are provided with a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us.

INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

ORIGINAL ARTWORKS PURCHASING ENQUIRES

Our speciality is the creation of fine art prints, and we do not get involved directly with the sale of original artwork; however, as a service to you (the Buyer) and the artist (the Seller) we will pass over to the artist any interest you may have in purchasing an original artwork (where available) . After that all further communication and any financial transactions will be directly between the Buyer and the Seller, including any method of delivery or collection of the original artwork and any returns agreement you reach. Any purchase of orginal artwork you make will be under contract between the Buyer and the Seller (including any terms and conditions of sale) not with Select Art; and Select Art will have no influence or involvement over that, and we exclude all liability arising from the purchase contract, including any consequental losses arising from either the Buyer or the Seller under your agreement with the artist. If you go ahead with a purchase of orginal art it is your responsibility to ensure that you are happy with the basis of the contract between you, the Buyer and the artist, the Seller.

Any dispute with respect to the sale of any original artwork shall be resolved between the you and the artist and without the participation of Select Art. Select Art does not guarantee and is not responsible in any way for the performance of Buyers or Sellers participating in the sale of original artwork arising from enquiries through our site.

LIMITATION OF OUR LIABILITY

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

We assume no responsibility for the information displayed on our site by our users, and we make no guarantee, warranty or representation as to its accuracy. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
